SUPREME COURT DECISION HAS "SILVER LINING"

Although abortion is not morally or ethically justifiable, it has been the unfortunate reality that killing a baby for any reason at any time was the law of the land - until the Gonzalez v. Carhart U.S. Supreme Court decision last month. Now, for the first time, we have some federally imposed limits on abortion. While this is not a complete victory by anyone's imagination, it is a strategic victory that could be used to advance the goal of complete abortion abolition.

There has been some misunderstanding of the recent Supreme Court decision because of a misunderstanding of how courts work. Judges rule on narrow legal questions presented before them. They do not rule widely on every issue related to a case, but only on the specific arguments made by the parties. In this case, the Gonzales v. Carhart decision applied specifically to the question of the constitutionality of a ban on live, intact D&E abortions done using a particular procedure. The Court gave the pro-life movement exactly what it was asked for when it upheld the ban on that one, specific procedure.

Confusion came because the majority ruling written by Justice Anthony M. Kennedy explained that other abortion procedures fall outside the scope of their decision, leading some to believe that tacit approval was being given to certain abortion procedures.

The Gonzales v. Carhart decision did not give new permission or approval to kill babies in other ways. Those methods are shamefully already permissible under America's liberal abortion laws, and further approval is not required. Kennedy was simply clarifying the limitations of the ruling. Remember, courts can only rule on the specific legal questions at hand, not on every aspect of a particular subject before them.

Misunderstandings aside, there are several silver linings in the Gonzales decision. First, we have an indication that unfettered abortion on demand is no longer an untouchable issue with the Supreme Court. This deviation from "stare decisis" is good news! Now is the time to get some good challenges to abortion in the pipelines so that a decision that is more targeted to the heart of Roe v. Wade and it companion case, Doe v. Bolton, can be rendered. Now the loss of the South Dakota abortion ban, and its legal challenge is most grievously felt because it would have hastened a direct challenge to those landmark decisions.

Secondly, the court ruled that a health exception is no longer a constitutional requirement for laws that limit abortions. This is good news, especially for the babies in Kansas where a proper application of state law would put an end to George R. Tiller's barbaric late-term abortion butchery. "Health" exceptions have become massive loopholes, which nullify laws that have been enacted in attempts to save at least some lives that our courts have put at risk. Now those loophole health exceptions can be omitted from laws, and should result in more lives saved, if the pro-life movement can pass more stringent legislation.

Another bit of good news from Gonzales is that the abortion industry will no longer be able to use the scare tactic of wildly hypothetical arguments at the U.S. Supreme Court level. From now on, any argument must include real women facing real situations, not blanket "what if" scenarios that have not, and likely will not ever have a basis in reality.

The fourth positive aspect to the Gonzales ruling is that the decision has spurred public discussion of abortion, and when that happens, the pro-life side wins, because support for the murder of innocent children in the womb is an indefensible position. Debate allows people see through the strained and dishonest rhetoric of the abortion cartel. That is one of the reasons America is becoming increasingly pro-life.

While the ruling may be less than some had hoped, the pro-abortion side certainly views the Gonzales decision as a demoralizing defeat. Thus, pro-life arguments vilifying the ruling only tend to give aid and comfort to the enemy. Now is the time for an optimistic and aggressive approach. The pro-life movement needs to use the positive aspects of this decision to our advantage in pressing forward the cause of life.

The Gonzales v. Carhart case did what it was asked to do, and that is to ban a specific abortion procedure. The health exception ruling and other positive aspects of the case are icing on the cake. It is the first prohibition on any abortion procedure since Roe v. Wade, and a good first step by the Court toward abolition. However, the Court will not abolish abortion unless it is asked to. We need to get solid cases into the judicial pipeline now, so that abolition can become a reality sooner than later.

NY Governor Spitzer Pushes Abortion and Gay Marriage

Signs on to Day of Prayer Under Public Pressure

NEW YORK, May 1, 2007 (LifeSiteNews.com) - NY Governor Eliot Spitzer has introduced legislation that would establish legal recognition for homosexual unions in the state, and has pledged to bring forward a bill that would strengthen the state's abortion laws, in anticipation of potential legal challenges following the Supreme Court's decision to uphold the ban on partial birth abortion procedures.

Gov. Spitzer introduced a measure on April 27 that would eliminate gender from the legal definition of marriage and make denying a marriage license to homosexual couples illegal. Mr. Spitzer ran his election campaign on a platform that included legalizing same-sex marriage in the state.

The legislation would open the door to gay marriage in the state, in the first instance of a governor initiating a change to the traditional definition of marriage. The bill has little likelihood of passing the state legislature, however, according to a report by The Daily Princetonian.

The governor followed his introduction of pro-homosexual legislation with a pledge Wednesday to bring forward a bill that would widen the scope of the state's abortion law.

The Reproductive Health and Privacy Protection Act would expand the current health clause to permit abortions late in pregnancies, banned under the original state law, the New York Times reported April 25. The Act would also remove abortion from criminal statutes--abortion is officially considered an act of homicide in the state but with broad exceptions that, in practice, allow for abortion on demand during the first two trimesters of pregnancy.

Mr. Spitzer announced the coming proposal at a Manhattan luncheon hosted by Naral Pro-Choice New York. Interestingly, the governor's mother is a board member of an organization closely affiliated with Naral, and was bestowed with a lifetime achievement award at the event, according to the Times.

In related news, after a delay of nearly a month and a concerted campaign of phone calls to his office by individuals from across the country, Mr. Spitzer finally signed a proclamation supporting the annual National Day of Prayer (NDP), held every year since 1952 on the first Thursday in May, with governors from all states signing the annual proclamation.

According to the NDP task force's official policy statement, "[The] diversity [of Americans] is what Congress intended when it designated the Day of Prayer, not that every faith and creed would be homogenized, but that all who sought to pray for this nation would be encouraged to do so in any way deemed appropriate."

When repeated requests to Gov. Spitzer's office failed to produce the required signature, Focus on the Family's CitizenLink eventually issued an alert requesting concerned citizens contact the office to complain.

"After being flooded with phone calls from family advocates around the nation, New York Gov. Eliot Spitzer today joined the other 49 governors in issuing a proclamation supporting Thursday's observance of the National Day of Prayer (NDP)," CitizenLink reported last week.

Mr. Spitzer signed the proclamation April 25, just four days prior to the event. The deadline requested for his signature had been April 1. Press secretary Christine Anderson told CitizenLink the governor "always intended to sign it," saying delays can happen in paperwork.

Bush Proclaims 56th Annual National Day of Prayer - May 3


American Humanist Association will observe a National Day of Reason instead

WASHINGTON, May 1, 2007 (LifeSiteNews.com) – "A prayerful spirit" has always been an important part of the American national character, says President George W. Bush. With this assertion, he has proclaimed May 3rd as the 56th annual National Day of Prayer.

The National Day of Prayer was established in 1952 by a joint resolution of the United States Congress and signed into law by President Harry S. Truman and is normally observed on the first Thursday of May.

This year's theme is "America Unite in Prayer," and will begin at 1:16pm EST in Washington, D.C. with music, celebrations and remembrances throughout the country.

Bush said that a belief that God "hears the prayers of His children and shows grace to those who seek Him" is common to many Americans. Citing the massive outpouring of prayerful responses after the shootings at Virginia Polytechnic Institute, Bush said, "There is a power in these prayers, and we can find comfort in the grace and guidance of a loving God."

Public Law 100-307, calls on citizens of the US to "reaffirm the role of prayer in our society and to respect the freedom of religion."

While churches across the country prepare events to participate, secularists have reacted predictably to the announcement. Fred Edwords of the American Humanist Association which holds there is an natural divide between between faith and reason, says his organization and others will observe a National Day of Reason instead this Thursday.

The 2008 Election battle is well underway. But the battlefield, at this stage of the election, is not in the voting booth, and not even in the bank.

It's in the mind.

It's a psychological war, a war of mental categories, assumptions, prognostications, and declarations of "done deals" before they're done. It's a war of polls and "front-runners," of probabilities and predictions.

There are two important stages to an election. Stage One, in which we are now, is the period of time when we get to decide who will be on the ballot. Stage Two, which comes after the primaries are all finished, is when we figure out who on the ballot should get our vote. These are two very different stages. Key to winning the psychological battle for the election is to keep reminding ourselves that we are in Stage One, not Stage Two.

The fact is that right now, nobody knows who will be on the ballot for the Presidential election in November of 2008. It could be any one of the candidates who have already declared their intention to run, or it could be someone we haven't heard of yet. As past elections have shown, "front-runners" at this stage of the process do not necessarily become the candidates on Election Day. And in the age of blogs and vlogs, circumstances in politics change faster than ever, and the dynamics of change are more numerous and unpredictable than ever. Many things still have to happen. Straw polls, debates, key endorsements, and the free media these things generate can catapult potential candidates into a much stronger position than they now enjoy.

That means that our focus right now should be on getting behind the person we think is the best candidate, and working to increase that candidate's name recognition and base of support. That's "Stage One" activity. Too many people, however, are thinking and acting as if the candidates have already been chosen. Too many are saying, for example, "We don't have a good pro-life candidate," or "The choices aren't so great." This is "Stage Two" thinking, as if we have already been handed the slate of candidates and have to be content to choose the best of a host of unsatisfactory options.

The bottom line is this: think for yourself. Don't let polls and headlines tell you who is most likely to be the nominee of any party. Rather, decide whom you want to support and work hard for that person. Websites like www.politics1.com and www.realclearpolitics.com are good sources for getting an independent and comprehensive view of the political landscape and those who are running or may run.

Finally, don't wait for anyone else to push you or give you permission to do what you know you should do. We already have all the mandate we need, in our rights as citizens and in the call of the Gospel to transform the world. Gather together with like-minded citizens, no matter what their religious affiliation, and get to work!
