The State's Interest in Life

Today the Supreme Court upheld the ban on partial-birth abortion that was enacted by Congress and signed into law by President Bush in 2003. This is a day of historic progress for the pro-life cause, whose ultimate goal is to restore protection to every unborn child, at every stage of development. Today, for the first time since Roe vs. Wade, the United States of America has actually banned an abortion procedure, rather than just regulated it.

The pro-abortion forces attempted to strike down the ban because it does not have a health exception. The Court, however, said that the ban's opponents failed to demonstrate that the need for a health exception was extensive enough to render the law unconstitutional. The Court also rejected the arguments that the ban is too broad or too vague. The wording of the ban is clear enough for abortionists to know when they are and are not violating the law.

The decision in this case is refreshing to read, because it emphasizes that the state has a legitimate interest in the life of the unborn child throughout pregnancy. Nor is this the first time the Court has recognized this interest. The decision refers to the state's right to "express profound respect for the life of the unborn," and affirms "that the government has a legitimate, substantial interest in preserving and promoting fetal life." The partial-birth abortion procedure differs from other abortion procedures in that it actually hijacks the delivery process and turns it into a method of killing, and hence obscures the role of the physician in the birth process. The Court today reaffirmed the state's "legitimate interest in regulating the medical profession in order to promote respect for life, including life of the unborn." The decision also asserts, "The State has an interest in ensuring so grave a choice is well informed." In reaffirming these legitimate state interests in defense of the partial-birth abortion ban, the Court is also pointing the way for continued pro-life legislative activity at the state and federal level.

Today's decision also reminds us that elections matter. The work done by so many pro-life people in the elections of 2000, 2002, and 2004 made this decision possible. The lawmakers who passed the ban were elected, as was the President who signed it into law. The Senators who confirmed the two new Supreme Court Justices were elected, as was the President who nominated those Justices. Today's fruit of these elections should lead us to renew our commitment to elect pro-life candidates in 2008.

As we give thanks for the ban on partial-birth abortion, we call for a vigorous and faithful enforcement of it. Moreover, state bans on the procedure should likewise be put into effect in a manner consistent with the federal ban upheld by today's decision.

This decision draws a significant and necessary line that stops the momentum of the abortion movement that believes it can justify any and every method of killing the unborn. The ban will indeed save lives.

U.S. Supreme Court Upholds Federal Ban On Partial-Birth Abortions

ANN ARBOR, MI — The United States Supreme Court today issued a sharply divided 5 - 4 ruling upholding the Federal law that bans Partial-Birth Abortions. The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, had filed a “friend-of-the-court” brief with the Supreme Court supporting the Federal ban. The brief was filed on behalf of the Law Center, the National Pro-Life Alliance, a nonpartisan coalition of over 600,000 pro-life Americans, and the Catholic League for Religious and Civil Rights, the nation’s largest Catholic civil rights organization.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, commented, “Today’s Supreme Court decision may very well signal the willingness of the Court under Chief Justice Roberts to revisit its infamous Roe v. Wade decision and end legalized abortion in this country. Its immediate effect is to overrule the ‘undue burden’ test for facial challenges to abortion restriction statues.”

At issue in the case was the constitutionality of the 2003 Federal law that bans a particularly barbaric and gruesome abortion procedure used in the fifth or sixth month of pregnancy where the unborn child is removed from the mother’s womb except for the head. The doctor punctures the child’s head, sucks out the brains in order to collapse the skull, and then removes the dead child from the mother.

Immediately after the 2003 Act was signed into law by President Bush, pro-abortion groups filed federal lawsuits in New York, San Francisco, and Lincoln, Nebraska. Lower federal trial courts and appellate courts found the ban unconstitutional in all three cases and enjoined its enforcement. Those rulings have now been reversed by the Supreme Court, and the 2003 Act goes into effect.

The Supreme Court’s decision was authored by Justice Kennedy, who was joined by Chief Justice Roberts and Justices Scalia, Thomas, and Alito. Justices Ginsburg, Stevens, Souter, and Breyer dissented from the decision. Justice Ruth Bader Ginsburg read her bitter dissent from the bench.

Edward L. White III, trial counsel with the Thomas More Law Center, explained, “In our brief, we argued that the Partial-Birth Abortion Ban Act of 2003 was constitutional and permissibly regulates abortion. We explained to the Supreme Court that to abandon this legislation would herald a new era in which the value of any pre-born human life would no longer be protected by our courts or our Constitution. I am glad the Supreme Court decided to support the culture of life and reject the culture of death that is spreading across this nation.”

Particularly captivating were his very authentic sounding Mother Angelica impersonations which beyond sounding like the saintly nun were in content and tone nearly identical to the original.

In an interview with LifeSiteNews.com, Arroyo explained Mother Angelica's devotion to the pro-life cause. He said that Mother's "own infirmities and being someone who was honestly forgotten and pushed aside by so many people" were motivating factors in that devotion.

"She had a great appreciation for life, no matter the state of that life, or our perception of the state of that life," he said.

In his new book titled "Mother Angelica's Little Book of Life Lessons and Everyday Spirituality" Arroyo writes of a saying of the EWTN foundress noting that there is no greater power in the world than disabled children, children with Downs Syndrome. Asked about his own devotion to a faith which is regarded by some as out of step on issues such as abortion and homosexuality, Arroyo replied, "I think as Catholics we are called to embrace and to defend the full teaching of the Church, in its totality. It all hangs together."

The host of the popular EWTN show The World Over Live which is seen in more than 100 million households each week added: "I have friends who want to pull one thing out or want to exempt themselves from another whether it be contraception or embryonic stem cell research because they have a sick relative or they feel they have enough children." He told LifeSiteNews.com, "We can't do this. Once you begin to pull one thread out, the whole garment begins to unravel. It is one piece. It's a whole cause and vision of life. Its not our vision of life, or your vision of life or Mother Angelica's vision of life - it is God's vision of life and since He is the Creator, we owe him some deference here. Planned Parenthood Condom TV Ad Mocks Religion, Angels

SAN FRANCISCO, April 17, 2007 (LifeSiteNews.com) - Planned Parenthood Golden Gate (PPGG) has just released a "Safe is Sexy" television ad that features a young couple being interrupted from having unprotected sex by their Guardian Angels. The ad, which will appear on MTV, VH1 and FX, shows a sloppy-looking male angel eating popcorn at the head of the bed watching in delight. Then his female counterpart appears imploring him to do something. He accesses a TV remote and rewinds the scene of the couple in bed. This time the woman asks her male partner if he has any protection, to which he exclaims, "Yeah, of course." She responds, "Amen!"

Catholic League president Bill Donohue commented on this ad saying, "Given the moral hollowness of Planned Parenthood, it is not surprising to learn that it is now in the business of hijacking religious imagery to pander its sex-without-consequences message. But as with PETA before it, the anti-natal salesmen will find that the faithful will tune them out."

Donohue added: "Ironically, while PPGG is ripping off Guardian Angels, the California chapter of Planned Parenthood is lobbying to defeat the 'Missing Angels Act.'"

The bill, which is being pushed by women who have experienced stillbirth, would require a certificate of birth when this occurs. Currently, all states are required to issue a death certificate for a stillbirth; they also require the family to bury or cremate the baby.

Joanne Cacciatore, who heads the Missing Angels Foundation, has said, 'How in the world do states ethically justify telling someone they have to bury someone who they are not willing to say existed?'

"What really galls Planned Parenthood," said Donohue, "is the fear that the bill would help the pro-life movement by acknowledging the humanity of the unborn child; the bill says the fetus must have advanced beyond the 20th week of gestation."


"It looks like the only kinds of angels Planned Parenthood wants to affirm are those that service its deadly agenda. Planned Parenthood is to religion what matricide is to Mother's Day."

Commenting on the ad on her Dawn Patrol blog, Dawn Eden of the New York Daily News, said "Planned Parenthood has long had a relationship of sorts with the Angel of Death; it invites him into its clinics a quarter-million times a year."

Rudy Giuliani Tells Pro-Life Advocates: Get Over Abortion Issue

Washington, DC (LifeNews.com) -- After getting national attention last week with comments supporting taxpayer funding abortions and calling the funding a "right," Rudy Giuliani thumbed his nose at the pro-life movement further over the weekend telling them to get over the issue of abortion.

Giuliani, the former New York City mayor, has seen his polling numbers decline slightly because of his wide difference with most Republicans on the issue of abortion.

He's previously indicated that he will let Republican judge him on his track record and stances and determine on their own whether he's qualified to get the GOP nod for president in 2008.

Though merely admitting to a disagreement on the issue before, Giuliani went further this weekend, telling an Iowa newspaper that pro-life advocates should get over the contentious issue.

"Our party has to get beyond issues like that," he told the Des Moines Register newspaper.

He also appeared to indicate that the Republican Party won't gain supporters if it retains its pro-life position.

"Our party is going to grow, and we are going to win in 2008 if we are a party characterized by what we're for, not if we're a party that's known for what we're against," he said.

However, the GOP has nominated pro-life presidential candidates in every race since 1980 and it has won five of the seven contests -- all against pro-abortion Democrats.

Pro-abortion Republican President Gerald Ford lost to Jimmy Carter in 1976 in part because Carter was seen as more conservative on abortion and other social issues.

Polls have also shown that abortion is a winning issue for GOP presidential candidates.

Post-election polling after the 2004 presidential elections found that President Bush's pro-life stance gave him an edge over pro-abortion Sen. John Kerry.

A 2004 Wirthlin Worldwide post-election poll found that 42 percent of voters said abortion affected the way they voted for president. Twenty-four percent of voters cast their ballots for President Bush while 15% voted for Kerry, giving Bush a 9 percent advantage on the issue of abortion.

Eight percent of voters in the Wirthlin poll indicated abortion was the "most important" issue affecting their votes and Bush won among those voters by a six to two percent margin, leading Kerry by four percentage points among the most intense abortion voters.

Exposé: Operation Rescue Uncovers Tiller History Of Illegal Abortions


Like father, like son: Tiller family criminal conduct spans seven decades

Wichita, KS - April 16, 2007 - Operation Rescue has uncovered three source documents that reveal a pattern of illegal abortions by the Tiller family of Wichita, Kansas, spanning seven decades.

"George Tiller himself has a documented pattern of disregard for the law across four decades," said Operation Rescue President Troy Newman. "It gives further urgency to the need to allow the criminal case filed against Tiller in December to move forward without further delay."

Late-term abortionist George R. Tiller has admitted in a signed statement that he has a history of committing illegal abortions.

A statement, released by Voices of Choice in July, 2005, regarding the impending appointment of a replacement for U.S. Supreme Court Justice Sandra Day O'Connor states in part, "As physicians who provided or facilitated abortions before Roe v. Wade, we saw the horrors of illegal abortion first-hand." Fourteen abortionists, including George R. Tiller, signed the statement. (Read full statement.)

In two other documents, an undated interview published by Voices of Choice and an article from the Wichita Eagle dated Sept. 8, 1991, Tiller describes in his own words that his father, Jack Tiller, provided illegal abortions for women in his family practice as far back as the 1940s. Tiller admits that his discovery of this fact inspired him to abandon a career in dermatology and pursue a career as an abortionist.

In December, 2006, George Tiller was charged with 30 counts related to the commission of illegal late-term abortions. Those charges were dismissed on dubious jurisdictional grounds, and stonewalling tactics have been employed by Attorney General Paul Morrison, including the firing of a special prosecutor, to keep the case out of court.

Meanwhile, witnesses say that illegal abortions continue at Tiller's Wichita late-term abortion mill, Women's Health Care Services.

One witness, sidewalk counselor Donna Lampkin, told Operation Rescue on March 23, 2007, that she was personally spoke to one woman who admitted that both she and her pre-born baby were perfectly healthy, but that she was seeking a late-term abortion at Tiller's WHCS solely due to financial reasons. This abortion violated K.S.A. 65-6703, which bans post-viability abortions, with narrow exceptions, financial considerations not being one of them.

On April 14, 2007, Dawn McClelland posted the following comment at ChargeTiller.com, a website supporting the reinstatement of criminal charges against Tiller:

As a director of a crisis pregnancy center, I have worked directly with women/girls who have gone to Tiller. One was 32 weeks pregnant, under the care of one of our doctors. Her health and the health of the baby were both good. Her family told her she would be disowned if she had the baby. She panicked. Planned Parenthood directed her to Tiller, where this perfectly healthy little baby was killed and the mother scarred for life. We are barbarians to let this happen.

"This information about Tiller's long history and continuing practice of committing illegal abortions establishes a pattern of criminality on Tiller's part," said Newman.

"These documents and eyewitness accounts also give us a glimpse into his frame of mind. Tiller returned to Wichita after his father's death and took up the family practice, following in his dad's footsteps. Now we see that the Tiller legacy includes violating the law by providing illegal abortions."

Operation Rescue believes that the documents show more that a casual disregard for Kansas Statutes. "They show a brazen contempt for the law as well as for the lives of his innocent victims," said Newman.

"Every man and woman in authority in Kansas who has blatantly ignored Tiller's illegal killing of viable babies has innocent blood on their hands. No amount of political payoffs is worth the lives of these precious children, or the bloodguilt that haunts the consciences of those who betrayed them. We appeal to Kansas authorities to stop this brutality, and immediately bring Tiller to justice in a court of law."

President Vows to Veto Stem Cell Bill

Washington, DC - President George W. Bush has promised to veto S. 5, a bill that would have provided federal funding for life-destructive experimentation on live human embryos. The bill thankfully lacks support for a veto override.

"It is immoral for the government to require our tax money to be spent on killing innocent people, even at the earliest stages of development," said Operation Rescue President Troy Newman. "Killing live human embryos has not yielded one promising cure for any disease, while stem cells derived from ethical sources hold much promise for easing human suffering. We should remember those in Congress who voted for this bill and pray that their eyes will be opened to the reality that taking innocent human life is not the answer to any of mankind's problems."

Omaha Protesters Vindicated

Omaha, NE - Seven pro-life protesters were vindicated in court yesterday after arrests for praying in an abortion worker's neighborhood. The group had been accused of violating an anti-residential picketing ordinance and disturbing the peace. All charges were dismissed. However, following the dismissal, the judge implemented a protection order against the group.

"If these people did nothing wrong, then why the need for a protection order? It is unnecessarily punitive for people exonerated of any wrong-doing," said Operation Rescue President Troy Newman.

In answer to prayer, the subject of the vigils, Karen Pender, no longer works in the abortion business.

Hialeah Homicide Needs New Autopsy

Miami, FL - The two main participants in the death of Baby Shanice Denise Osbourne, a baby born alive and intentionally killed in a Hialeah abortion clinic last year, have now been arrested and charged for the commission of illegal abortions at another abortion mill in Miramar. But the pair has yet to be charged with the brutal murder of Baby Shanice, where the gasping infant was shoved into a plastic bag filled with caustic chemicals and tossed onto the abortion mill roof.

It has been discovered that the original autopsy was conducted by an osteopath with very little experience, instead of a forensic pathologist. The report's determination that Baby Shanice's death was "natural" is hindering the progress of the murder case. An assistant prosecutor has asked for a second autopsy, but his request has been blocked.

Please call Dr. Bruce Hyma, Chief Medical Examiner, at 305-545-2400, and ask for a second autopsy on Baby Shanice Osbourne to be performed by a forensic pathologist, so there can be some measure of justice for this little girl.

    Topeka, KS - Governor Sebelius is using a Kansas law to order Attorney General Paul Morrison to challenge a recently signed bill allowing gambling in Kansas. Sebelius wants a quick court ruling to vindicate the bill so that investors will have confidence in going forward with plans to develop casinos in a number of communities.

    What is not being reported is that Sebelius is using the same Kansas law that the Kansas House is using to compel Morrison to prosecute George Tiller for doing illegal late-term abortions. Morrison held a news conference earlier this month to comment on the House efforts where he told the media that he believed the law was an unconstitutional violation of the separations of powers doctrine. Media referred to the statue is "little used" and "obscure." There have been no such proclamations in the case of the gambling bill challenge.

    "This just shows the hypocrisy of certain elements of the Kansas media and the politicians to which they give favorable coverage," said Operation Rescue President Troy Newman. "It is dishonest and manipulative. Apparently their hypocrisy knows no bounds."

Pat Mahoney of the Christian Defense Coalition in Washington, DC has confirmed that he will be joining us in Wichita on May 17-20 for our "Pray in May" 77-hour round the clock prayer vigil at George Tiller's abortion mill. We will be praying for Tiller and his employees to repent and stop killing children, as well as for Tiller to be brought to justice in a court of law for committing illegal late-term abortions.
