Operation Save America Vindicated in Wyoming Supreme Court

Reporter Ben Neary from the AP called me right after this ruling was released today. He asked for a response and boy did he get one. “We receive this news with tears of joy. We rejoice at this blow against tyranny and mighty defense of liberty. We not only prayed that God would move the court to grant us a favorable ruling, but that He would do it before we went back to Jackson Hole, WY. We are blessed to state that our Lord gloriously answered these specific prayers.”

 WE WON!

In May of 2011 gentle Christians from 13 states went to the last remaining surgical child killing center in Wyoming to proclaim the Gospel of Life.  The last day the city of Jackson, Wyoming issued a Temporary Restraining Order (TRO) against us to silence the Gospel.  Rev. Chet Gallegher and Pastor Mark Holick were eventually arrested (violation of the TRO) for preaching the Gospel in a public park (the town square). 

The arrests charges for defying the TRO were later dropped and through our very gifted attorney Jack Edwards, took the issuance of the TRO to the Wyoming Supreme Court. 

WE WON!  Thank you Lord Jesus! 

The court ruled:  “We find that the ex parte TRO was issued in violation of the First Amendment to The United States Constitution and Rule 65 of the Wyoming Rules of Civil Procedure and reverse.”- Wyoming Supreme Court, April Term, A.D. 2012, Operation Save America Appellant (Defendant), v. The City of Jackson Appellee (Plaintiff) 

Saints, this is truly OUTSTANDING – GOOD NEWS for us, for liberty, and for America!  I have not read through all of it yet but on page 27 (#67) the Wyoming Supreme Court stated; OSA’s speech is protected public issue speech, and based on these precedents, any restriction on that speech must be carefully scrutinized.  We find that this level of protection must likewise be extended to the graphic photographs OSA chooses to use in its demonstrations.

Wyoming Supreme Court: Ban on Abortion Protest Unconstitutional!
CHEYENNE, Wyo., April 10, 2012 /Christian Newswire/ -- As Operation Save America begins its "States of Refuge" campaign (Statesofrefuge.org) we were greeted with some miraculous news from the Supreme Court of the state of Wyoming today. It ruled that a lower court order prohibiting gentle Christians from displaying graphic signs of "aborted" and "living" babies at the Jackson town square last year was unconstitutional.

In a 3-2 decision released Tuesday, April 10, 2012, the Wyoming Supreme Court ruled the temporary restraining order (TRO) issued by District Judge Tom Day violated the First Amendment rights of members of Operation Save America. On page 27 of the 43 page decision the court said, "OSA's speech is protected public issue speech, and based on these precedents, any restriction on that speech must be carefully scrutinized. We find that this level of protection must likewise be extended to the graphic photographs OSA chooses to use in its demonstrations."
