Recent developments with the same-sex marriage battle in Illinois

Illinois Legislature Warned of the Irreparable Harm the Legalization of Same-Sex Marriage Would Cause

On January 3, 2013, Thomas More Society sent a letter to every member of the Illinois General Assembly educating them on the harm a “yes” vote for the “Religious Freedom and Marriage Fairness Act” would have on the state of Illinois. The Illinois General Assembly is expected to vote on this bill that would legalize same-sex marriage during the lame duck session this week.

Dear Member of the Illinois General Assembly:

We strongly encourage you to oppose the “Illinois Religious Freedom and Marriage Fairness Act.” From our experience protecting the constitutional rights of Illinois residents for over 15 years, we believe that this Act is both unnecessary and gravely harmful to religious liberty rights. In 2010, the General Assembly enacted a civil union law which provided the same rights and privileges to civil union couples as are enjoyed by married couples. Because of that civil union law, Illinois’ same-sex civil union couples already have the same substantive legal rights as married couples do.

However, if you vote “yes” to the proposed same-sex marriage bill, you will harm your constituents in two primary ways:

1) You will declare your constituents who believe that marriage is a union of one man and one woman to be bigots and discriminators. You will further ensure that this declaration is reinforced through official government policy. For instance, as in other states, you may see public schools in your district instruct children, beginning in kindergarten, that (a) same-sex couples and same-sex sexual activity are the same as opposite-sex married couples and opposite-sex marital sexual activity or that (b) kids do not need both a mom and a dad – two moms or two dads are just as good. Parents in your district who disagree have no right under law to opt their young children out of this kind of instruction.

2) You will strip away the meager religious liberty protections of the 2010 civil union law, as these protections are not included in the 2013 same-sex marriage bill. These religious liberty protections currently provide explicit shelter to Catholic Charities and other faith-based adoption agencies in providing private adoptions. These protections also shelter Evangelical, Catholic, and other faith-based organizations, including hospitals and schools, from being charged with Illinois Human Rights Act violations when they follow their beliefs on marriage in employment, facilities rental, and other decisions. Penalties for violating the Human Rights Act include fines, injunctions, and other penalties intended to force acceptance of same-sex unions.

What benefit would a “yes” vote provide to same-sex couples? The mere changing of a title of a license – such that the license for most same-sex unions would now read “marriage license” instead of “civil union license.” And, if the example of other states holds true here, the words “Husband” and “Wife” would be stricken from marriage licenses in favor of “Party A” and “Party B.” Again, a “yes” vote on same sex marriage would not grant a single additional substantive legal right to any homosexual couple in Illinois.

However, there are likely more grave harms, yet unknown in type and intensity, that will afflict your constituents who are faithful Catholics, Evangelical Christians, Missouri Synod Lutherans, Muslims, Mormons, and Orthodox Jews. The harms listed above are only the likely harms foreseeable in the short-term.

The harms noted above do not begin to address the suffering of your constituents who must participate in and support same-sex unions: small bed & breakfast owners who would be forced to rent out their home for same-sex wedding weekends; solo photographers who would be forced to spend hours photographing and designing albums for same-sex wedding ceremonies that they believe to be sinful; family catering company owners being forced to prepare, feed, serve, and support same-sex wedding receptions, even though the family members oppose those receptions with every fiber of their being. In other states, such businesses have been fined and subject to injunctions, some even permanently shutting down to avoid legal penalty.

A “yes” vote will inflict these harms, all for the sake of giving the title “married” to some number of the fewer than 1% of Illinois households headed by same-sex couples.

This morning, several amendments that purport to protect religious liberty were rushed through that made the bill worse, not better. The alleged “protection” for religious hiring is so weak that it wouldn’t protect Catholic and Christian grade schools from being forced to hire teachers in same-sex marriages. The section on facilities rental wouldn’t protect most parish halls and Knights of Columbus halls from being enlisted into service for same-sex wedding ceremonies, since many of those halls are not used “primarily … for worship or religious purposes.” The section defining “religious organizations” wouldn’t protect Catholic hospitals and healthcare facilities, Catholic Charities, the Knights of Columbus, and other religious service and fraternal organizations. Only time will tell whether organizations would be forced to shut down or significantly reduce their ministries in order to avoid the reach of the “Religious Freedom and Marriage Fairness Act.” Of course, none of this morning’s amendments even acknowledge the conscience issues faced by people of faith who are forced into participating in these ceremonies.

Titling this measure, “Religious Freedom,” is an insult to people of faith – your constituents who go to church weekly, quietly serve their community, and merely ask to be allowed to live out their faith in their daily lives.

Our national motto, E Pluribus Unum, teaches us that while we are one nation, we are a union of many folks of different races, colors, and creeds.  Thus we teach tolerance as a solvent that melds us together in a shared political community in spite of our differences.  This measure, however, that purports to foster tolerance, swings the pendulum so far as to epitomize intolerance, forcing a vast segment of society to act at odds with their conscience and to behave in ways that offend their fundamental beliefs about right and wrong.  In the name of tolerance, then, this bill must be rejected.

(Chicago, IL) January 3, 2013 – Today the state legislators of Illinois were warned about the documented consequences of legalizing same-sex marriage. The Thomas More Society, a public interest law firm focused on protecting constitutional rights, sent letters to each member of the Illinois General Assembly, encouraging them to oppose the “Illinois Religious Freedom and Marriage Fairness Act.”

The missive, signed by Thomas Brejcha, President and Chief Counsel of the Thomas More Society, and Peter Breen, Executive Director and Legal Counsel, advised the lawmakers that voting “yes” to the proposed same-sex marriage bill will harm, rather than support, constituents. If passed, explains the letter, the discriminatory act will declare Illinoisans who support traditional marriage to be bigoted and prejudicial. As in other states that have passed this type of legislation, public children as young as kindergarten may be taught about same-sex sexual activity, and parents who disapprove will have no right to opt their children out.

The Thomas More Society communique points out that the deceptively titled “Illinois Religious Freedom and Marriage Fairness Act” will actually strip away the meager religious liberty protections of the 2010 civil union law. The current law allows faith-based adoption agencies, hospitals, and schools to follow their deeply held convictions in regard to employment, facilities rental, and other decisions. Under the proposed act, threat of being charged with Illinois Human Rights Act violations will unconstitutionally coerce acceptance of same-sex unions.

The only documented benefit to Illinois’ same-sex couples, assert Brejcha and Breen, would be a change in wording from “civil union license” to “marriage license,” a vanity not worth the disenfranchisement of large segments of the state’s population. The current law already provides same-sex couples the rights of married couples.

They contend that the proposed act will do great harm to the religious liberty all Americans are guaranteed under the Constitution of the United States. Rather than promote civic tolerance, the “Illinois Religious Freedom and Marriage Fairness Act” will legalize intolerance.

  • In Michigan, Governor Rick Snyder signed into law a pro-life package that will allow state health officials to inspect all 32 abortion businesses across the state – 28 of which are not licensed and have rarely been inspected. SBA List activists in Michigan helped make this happen, teaming up with our friends at Michigan Right to Life who led the charge. 
  • In both Texas and Oklahoma, judges have ruled that the states can cut off taxpayer funding to abortion businesses like Planned Parenthood. In Texas, Planned Parenthood will no longer be eligible to participate in the Women’s Health Program, and in Oklahoma, Planned Parenthood will no longer administer WIC benefits to vulnerable mothers and children. Instead, women will now go to entities that provide real health care, not abortion. Special shout-out to our SBA List members in these states who took action, and especially to Texas Right to Life who led the fight to defund Planned Parenthood in The Lone Star State. 
  • In Virginia, Governor Bob McDonnell certified health safety standards for abortion businesses. Earlier this year, our friends at the Virginia Family Foundation, examined inspection documents through the Freedom of Information Act that found over 80 health and safety violations in just nine of Virginia’s 20 abortion businesses.

Viewpoint: Pro-Life and Feminism Aren’t Mutually Exclusive

From its early beginnings, feminism was a young women’s movement. Susan B. Anthony, Elizabeth Cady Stanton, Alice Paul, Charlotte Lozier and so many others began their suffragist work in their 20s. These women — the original feminists — understood that the rights of women cannot be built on the broken backs of unborn children. Anthony called abortion “child murder.” Paul, author of the original 1923 Equal Rights Amendment, said that “abortion is the ultimate exploitation of women.”
 

 
So the pro-life movement hasn’t changed the meaning of feminism, as has been suggested. It was the neo-feminists of the 1960s and ’70s who asked women to prize abortion as the pathway to equality.
 
Marjorie Dannenfelser, along with a group of mostly Democratic women, started the Susan B. Anthony List in 1992, the so-called Year of the Woman, when numerous pro-choice women were elected to Congress.
 
Dannenfelser, then in her mid-20s, saw a need to support more pro-life women running for elected office. Twenty years since the organization’s founding, we now have two pro-life women in the Senate, 17 in the House, four in governorships and hundreds more in state legislatures.
  
Pro-life feminism has captivated a new generation of young women who reject the illusion that to be pro-woman is to be pro-choice. Gallup polling showed that among 18-to-29-year-olds, there was a 5% increase in those labeling themselves “pro-life” between 2007–08 and 2009–10. The past few years have seen the emergence of young leaders like Kristan Hawkins of Students for Life of America, who is responsible for organizing more than 675 pro-life groups on college campuses across the nation, and Lila Rose of Live Action, whose undercover video work has forced the abortion industry to confront and amend practices it cannot defend, as well as dozens of other future leaders who have assisted our organization as staff members and interns. During the past two summers we’ve had young female leaders join the SBA List from Stanford, Georgetown, the University of Wisconsin-Milwaukee and the University of California, Berkeley. These passionate defenders of women and unborn children return to their campuses ready to lead pro-life groups and educate their classmates on the tragedy of abortion.

That was the case in Portland, Oregon, on December 3 when the school board entertained comments on the topic of Planned Parenthood's Teen Outreach Program (TOP) in the public schools. Agents Arrest 245 Alleged Pedophiles

U.S. Immigration and Customs Enforcement agents announced today they have rescued 44 children from sexual abuse as part of a child pornography investigation that netted 245 arrests over five weeks late last year.
Agents have identified an additional 79 individuals who have been abused as children including 24 victims who now may be adults and are seeking the public's help to identify individuals who are alleged to be sexually abusing young children, with the images posted on the Internet.

Last month, a letter was circulated online asking for prayers and cards of support for Father Luke Suarez, parochial vicar at St. Rose of Lima parish in Newtown, Connecticut. (There are two other priests at the parish as well — Father Ignacio Ortigas and Monsignor Robert Weiss.)

Mennonite Company Wins Injunction Stopping Obama HHS Mandate
Most of the lawsuits against the pro-abortion HHS mandate in Obamacare have come from Catholic or evangelical groups or businesses. In one case, Conestoga Wood Specialties, a Mennonite-owned company based in Lancaster County Pennsylvania, filed a federal suit against the mandate, which forces employers to cover abortion-causing contraception for their employees.

Teenager From Brazil Offers Her Virginity for Sale
An 18-year-old girl is auctioning off her virginity on YouTube and says she plans to use the money to help her ailing mother. A television network has offered to pay for her mother s medical expenses so the teenager won t resort to the wild-eyed idea.

IRS Looks to Force Obamacare on Employers Who Cut Staff
A few months ago I predicted here that Obamacare would result in a great chase, by which I meant that smaller employers would react to the health insurance mandate by reducing staffing to under 50 full time employees to escape the requirement. This will, I predicted, set off a great chase: From my post, Obamacare and the Great Chase :

Businesses will try to cut their losses by reducing employee hours or by keeping their workforce under 50. The technocrats will respond by changing the rules, say, by lowering the full-time employment requirement to 40 and/or reducing the number of hours worked that qualify as full time employment. 2012: Second Highest Number of Pro-Life Laws Passed on Abortion
During 2011, state legislators set a record by approving more pro-life laws stopping and limiting abortions than any other year since Roe v. Wade in 1973. A new report issued today shows that last year, legislatures approved the second highest number.

Although some media outlets and abortion advocates say the November presidential election marked a defeat for the pro-life movement, the number of abortions is at its lowest level nationally and states are seeing historic low abortion figures thanks in large part to state pro-life laws.
