Deceased abortionist’s bankruptcy leaves injured woman who won malpractice lawsuit with nothing

A final hearing is scheduled on Nov. 2 at 11 a.m. in U.S. Bankruptcy Court in Riverside to finalize a bankruptcy petition filed six years ago by now-deceased abortionist Dr. Joseph Durante. 

When Durante filed for bankruptcy in September 2004, he was facing a malpractice lawsuit from a woman who suffered a botched abortion at his hands and almost died. By filing for bankruptcy in federal court, Durante was able to avoid paying any judgment in the malpractice case. 

The patient, Ana Marie Santana, suffered sepsis and a perforated bowel subsequent to an abortion at Dr. Durante’s office. When Dr. Durante ignored her symptoms, she went to the emergency room at a nearby hospital and was taken promptly to surgery. 

Attorney Jack Schuler of Schuler, Brown and Ekezian in Van Nuys ultimately obtained a judgment against Dr. Durante for more than $300,000 -- but the judgment went into the bankruptcy court.
