Judge Declares Pro-Abortion ObamaCare Unconstitutional
A federal judge in Florida has issued a new ruling in what is the largest lawsuit filed against the Obamacare health care law. U.S. District Judge Roger Vinson says the individual mandate is unconstitutional and, therefore, the entire law is as well. Leading pro-life groups have opposed the Obamacare law because it allows massive abortion funding and prompts concerns about rationing of health care.

The individual mandate is a portion of the law independent and conservative voters most strongly oppose because it requires Americans to purchase health insurance, that could fund abortions with taxpayer funds or premiums, whether they want to or not. The case the state of Florida and more than two dozen others made to Judge Vinson is that the individual mandate is unconstitutional and the Constitution does not allow Congress to regular financial inactivity.

"Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void," the judge wrote. "This has been a difficult decision to reach, and I am aware that it will have indeterminable implications. At a time when there is virtually unanimous agreement that health care reform is needed in this country, it is hard to invalidate and strike down a statute titled 'The Patient Protection and Affordable Care Act.'"

"Regardless of how laudable its attempts may have been to accomplish these goals in passing the act, Congress must operate within the bounds established by the Constitution," the judge wrote. "This case is not about whether the Act is wise or unwise legislation. It is about the Constitutional role of the federal government." Full story at LifeNews.com

Abortion Industry Forced to Suspend Centers Employing Gosnell
The abortion industry has been forced to suspend two abortion businesses that employed embattled abortion practitioner Kermit Gosnell, who has been the subject of national controversy over his abortion business in Philadelphia.

Gosnell's facility was the subject of a grand jury report for its horrifying conditions and Gosnell and several staffers have been arrested for killing a woman in a botched abortion and seven counts of murder related to the infanticide deaths of babies Gosnell would purposefully birth and kill with medical scissors.

The National Abortion Federation, a trade group which hundreds of affiliated abortion businesses, has been caught up in the controversy because it conducted an inspection of Gosnell's abortion center and found the practices so shoddy it became the first and only abortion center ever not allowed to join. However, NAF failed to notify state or local officials of the massive problems so Gosnell could be held accountable.

Now, following revelations that Gosnell is associated with two other abortion centers in Louisiana and Delaware, NAF has mad the decision to suspend the memberships of both. Atlantic Women's Medical Services, the Delaware abortion business that employed Gosnell one day a week to do abortions, and the Delta Clinic abortion center of Baton Rouge, have both had their memberships suspended. Bill Banning Tax-Funded Abortions Attacked Over Rape Issues
Leading pro-abortion activists are using the issue of rape as a method of attacking a new bill in Congress that would ban taxpayer funding of abortions across all governmental programs and agencies.

The measure, which is a number one priority for pro-life groups, would roll into one permanent law all of the many provisions and riders attached to the various bills funding the federal government that are passed each year. Instead of having to fight numerous battles – which don't always result in pro-life victories – every year with new members of Congress, the bill would ensure federal taxpayer funds don't pay for abortions in programs ranging from health insurance for federal employees to abortions in the District of Columbia to health programs at Indian reservations.

With a strong majority of Americans opposing taxpayer funding of abortions in polling data covering the last few decades, the pro-abortion movement is working to find a way to attack the bill on an issue that will get it leverage to derail the legislation. They appear to have found their issue: claiming the legislation women victimized by rape.

Under current federal law, taxpayer funding of abortion is stopped in the various provisions that are currently in force – such as the Hyde amendment – except in cases or rape or incest. Instead of using the current rape exception language now on the books, the bill changes the law to cover abortions in cases of "forcible rape." Full story at LifeNews.com

New DC Late-Term Abortion Biz Injects Babies, Abandons Women
James Pendergraft, a Florida-based abortion business owner has had his medical licenses suspended four times for violations, has reportedly opened up a new late-term abortion business in the Washington, D.C. area.
Pendergraft, who runs the Orlando Women's Center abortion business, has had his medical license repeatedly revoked for botched abortions, illegal late-term abortions, and dispensing drugs without a license. Now, the pro-life group Operation Rescue, says he has set up shop in a secret late-term abortion business somewhere in or near the nation's capital where late-term abortions are being only partially completed.

He also opened a new web site, LateTermAbortion.net, that describes in detail how his new office is soliciting women nationwide and from other countries for "intracardiac injection of medication into the fetal heart," which kills the unborn child. Pendergraft describes how his new abortion center uses long spinal needs to pierce the pregnant abdomen and inject the hearts of late-term unborn babies in the womb with poison or air.

Pendergraft makes it clear on the web site that he does not complete the abortion process at his new location but discharges patients 15 minutes after the injection and leaves them to go to their own personal physician or find a medical center nearby or in their home state to remove the body of the deceased unborn child. ABC News Publishes, Removes Story Attacking GOP on Rape, Abortion
ABCNews.com on Monday republished, then removed an article from Mother Jones magazine on Republicans "redefining rape." The piece briefly appeared on the network's website with no explanation that it was by the editor of the liberal magazine.

The article, by Nick Baumann, featured both the incendiary headline from Mother Jones, "The House GOP's Plan to Redefine Rape" and the nasty sub-headline: "Drugged, raped, and pregnant? Too bad. Republicans are pushing to limit rape and incest cases eligible for government abortion funding."

Unlike CBSNews.com, which has an opinion and analysis section, this article received no label. One could easily assume Baumann was simply an ABC News journalist. Full story atLifeNews.com

Jon Huntsman May Launch Pro-Life Republican Presidential Bid
Former two-term Utah Governor Jon Huntsman has stepped down from his position as ambassador to China and may launch a bid for the Republican nomination to face the pro-abortion president for whom he currently is a diplomat. Huntsman, who is pro-life and supported and signed into law parental consent requirement for abortion, is a Republican but is known for bucking the establishment and he did so when he accepted the nomination to become ambassador to the Asian nation. He did so in part because he learned to speak Mandarin while on Mormon mission to Taiwan during college.

Now he may be speaking the language of fundraising and grassroots support as White House officials tell both Poltico and ABC News they expect him to resign from his position to mount a bid for the Republican presidential nomination. They point to the fact that GOP political operatives have set up a new political action committee called Horizon Pac to serve as placeholder for what could become an exploratory committee. Susie Wiles, a Florida-based Republican strategist who ran the gubernatorial campaign of pro-life candidate Rick Scott, will head the organization. Full story at LifeNews.com

Georgia Lawmaker Promotes Fetal Pain-Based Abortion Ban
A Georgia state lawmaker is promoting legislation that would ban abortions after 20 weeks of pregnancy based on the scientific evidence that unborn children experience considerable pain from abortions.

The legislation is similar to a Nebraska law that is on the books but has not been challenged in court by pro-abortion groups. The law is credited with driving late-term abortion practitioner LeRoy Carhart out of the state — as he now works for a Maryland-based abortion business.

State Rep. Allen Peake of Macon said his bill, HB 89, is modeled after that successful legislation and explained that the bill has the support of the House Republican caucus and leaders and pro-life Gov. Nathan Deal would sign it into law.

"We believe there's clear evidence that it is feeling intense pain," he said, according to WMAZ. Full story at LifeNewscom

Carleton University Upholds Ban on Pro-Life Student Group
Carleton University's student association has upheld a decision it rendered last year about whether to kick out a pro-life group that won't acquiesce to its demands that it rework its charter to support abortion.
Carleton Lifeline lost its club status in November because of the student association's policy against discrimination, which mandates that student clubs respect the so-called right to abortion. Without officially recognized status, the pro-life club won't receive funding or access to space.

The student association decided in December rejected a policy change to allow pro-life student groups and, according to the Winnipeg Free Press, Ruth Lobo, Lifeline's president filed a challenge to that decision. Pennsylvania Supreme Court Weighing Parental Consent Abortion Law
The Pennsylvania Supreme Court will be hearing a case on the state's parental consent law that requires minor teens to get their parent's permission for an abortion. This is the first-ever review of the pro-life law by the state's highest court and it has received legal support from pro-life groups and state legislators who support the law protecting a parent's right to be involved in their child's decision regarding abortion.

The Pennsylvania law and others like it have already been upheld at the U.S. Supreme Court and pro-life groups argue that a Pennsylvania trial court judge applied the correct legal standard and legitimately exercised his legal authority under the statute when he rejected a minor girl's request for a secret abortion, stating that she needed consent from at least one of her parents. Full story at LifeNews.com

Baltimore to Appeal Decision Supporting Pregnancy Centers
The city of Baltimore and officials with the pro-abortion legal group Center for Reproductive Rights said over the weekend they plan to appeal a judge's decision striking down a law attacking pregnancy centers operating in the city.
A federal judge has struck down a Baltimore law that was the subject of a lawsuit brought by the Archdiocese of Baltimore because it unfairly attacks pregnancy centers that provide women with abortion alternatives. Full story at LifeNews.com

Florida Senator Nelson Could Face Strong 2012 Field
Senator Bill Nelson, a pro-abortion Florida, Democrat, will likely face a slew of Republican candidates as he prepares to run for re-election in 2012. Nelson has a 0 percent pro-life voting record according to the National Right to Life Committee.
