Despite
two very disappointing rulings, 38 states still define marriage as the
union of a man and woman -- including California, where Proposition 8 is
still the law of the land. Until an appeals court says otherwise, the
reports that the amendment has been struck down are untrue.

the final rule announced today is the same old, same old. As we said
when the proposed rule was issued, this doesn’t solve the religious
conscience problem because it still makes our non-profit clients the
gatekeepers to abortion and provides no protection to religious
businesses”

now, the right to define marriage is still reserved to the states,
which means that the political battle can continue — albeit amid a flood
of new lawsuits inspired by some of Kennedy’s arguments — in
jurisdictions where the national trend toward support for gay 'wedlock'
hasn’t yet overwhelmed the traditional view.
