Judge Rules Pro-Abortion ObamaCare Law Unconstitutional
A federal judge issued a ruling today on a Virginia lawsuit against the ObamaCare health care law that allows abortion funding and he said the program is unconstitutional in part.
The ruling makes the district court the first federal court in the nation to strike down a portion of the ObamaCare law and it goes against rulings other courts have issued striking down other lawsuits.
The key issue in the complaint the state of Virginia filed is that the individual mandate in the law, requiring Americans to purchase health insurance (which may very well fund abortions) is unconstitutional and a violation of the power Congress has to regulate interstate commerce.
Judge Henry Hudson issued a 42-page opinion writing that the individual mandate exceeds Congress authority, saying it is neither within the letter nor the spirit of the Constitution.
He said his survey of case law yielded no reported decisions from any federal appellate courts extending the Commerce Clause or General Welfare Clause to encompass regulation of a person s decision not to purchase a product, not withstanding its effect on interstate commerce or role in a global regulatory scheme.
Judge Hudson declined the request for an injunction stopping ObamaCare from going into effect any further while the case continues because the mandate hasn t taken effect yet. He noted the Supreme Court will become the final arbiter of the case. Full story at LifeNews.com
Republican Lawmakers Push ObamaCare Repeal After Ruling
Responding to today s ruling from a federal judge declaring the individual mandate portion of the abortion-funding ObamaCare law unconstitutional, top Republican lawmakers are pushing for a repeal of the entire law.
Speaker-elect John Boehner commented on the decision, calling for a repeal and saying states should repudiate ObamaCare now that it has been declared unconstitutional:
Today s decision is an encouraging sign for families and small business owners who have revolted against President Obama s job-killing health care law and called for its repeal. Instead of appealing this decision, the Obama Administration should work with Congress to repeal this job-killing health care law so we can replace it with reforms that lower costs and protect jobs. Republicans have made a pledge to America to repeal this job-killing health care law, and that s what we re going to do.
The individual mandate at the heart of ObamaCare puts the federal government in the business of forcing you to buy health insurance and taxing you if you don t. This is unwise, unaffordable, and as we have argued all along, unconstitutional. If Washington thinks it can get away with this kind of power grab, it will think it can do anything. Cash-strapped states should carefully weigh the benefits of investing time and resources in ObamaCare s implementation now that its central mandate has been ruled unconstitutional. Obama Admin Suggests More Embryonic Stem Cell Funding
Taking advantage of an appeals court ruling striking down an injunction against his forcing Americans to pay for embryonic stem cell research, the Obama administration is looking at more funding.
President Barack Obama, last year, issued an executive order forcing taxpayers to finance embryonic stem cell research that doesn t yet work in animals and has never helped a single human patient.
Two adult stem cell scientists filed a lawsuit seeking to overturn the order, saying it hurts the efforts of researchers working with adult stem cells the ethical kind that doesn t require the destruction of unborn human life to use to help patients.
A federal judge issued an injunction stopping federal funding, but the Obama administration appealed and an appeals court stopped the injunction while considering the merits of the lawsuit.
Now, an advisory panel to the National Institutes of Health (NIH) has recommended that four additional embryonic stem cell lines derived from obtaining stem cells from human embryos killed for their stem cells receive federal funding. Full story at LifeNews.com
Michael Steele to Seek 2nd Term as Republican Party Chair
When he holds a national conference call with leaders of the Republican National Committee, embattled party chairman Michael is expected to announce he will seek another term.
The decision is important because his potential withdrawal which had been speculated all weekend and most of today would have set up a free-for-all contest to determine who will lead the Republican Party heading into the all-important election to defeat pro-abortion President Barack Obama in 2012.
However, the Frum Forum and conservative media outlets reported this afternoon Steele is expected to announce he will seek re-election.
Steele has been facing questions of his handling of the party. He is pro-life but he has disappointed many grassroots conservatives by a lackluster fundraising effort and a poor get out the vote effort that is cited by some election experts as hurting pro-life Senate candidates in Washington, Colorado, West Virginia and elsewhere. Pro-Life Groups Applaud Judge s Ruling Against ObamaCare
Leading pro-life groups responded to a federal judge s decision today striking down the individual mandate portion of the ObamaCare law that they have opposed over abortion funding.
Every major pro-life organization has released a legal analysis of the ObamaCare bill saying it lacks sufficient provisions to stop abortion funding. They have also had to work to stop the Obama administration from funding abortions in three states through the high risk health insurance pools.
The American Center for Law and Justice, a pro-life legal group, called the federal district court decision in Virginiadeclaring the individual mandate of the health care law unconstitutional a sound decision which guts pro-abortion ObamaCare and represents a decisive and significant victory for America.
The ACLJ backed Virginia s lawsuit challenging ObamaCare in filing an amicus brief representing 28 members of Congress including incoming House Speaker John Boehner and incoming House Majority Leader Eric Cantor as well as more than 70,000 Americans. Full story at LifeNews.com
Obama s Popularity Reaches Low, Romney Would Beat Him
A new survey from the Marist Institute for Public Opinion shows pro-abortion President Barack Obama s popularity has reached a new low and potential opponent Mitt Romney would defeat him.
The survey shows Obama is losing support with his base Democrats and liberals who are frustrated with his lack of progress on their key issues.
Obama has also alienated Republican and independent voters with his push for a government-run health care system and taxpayer funding of abortions.
He s having the worst of both worlds right now, Lee Miringoff, the director of the Marist Institute, told McClatchy newspapers. As he moves to the center, he s not picking up support among independents and he s having some fall-off among his base. If his strategy is to gain independents and keep the Democrats in tow, it isn t working so far.
The poll, taken during the first week of December, shows just 42 percent of voters approve of the job Obama is doing while 50 percent disapprove.
Among Democrats, Obama s numbers have dropped from 83 percent a month ago to 74 percent today with the number disapproving of his job performance rising from 11 to 21 percent. With liberals, Obama dropped from 78 percent to 69 percent while his disapproval rose from 14 to 22 percent. Full story at LifeNews.com
Abortion Advocates Try to Disprove Study on Abortion-Mental Health Problems
Two pro-abortion research are trying to disprove a study showing women who have abortions are more likely to suffer from a variety of mental health problems than women who carry to term.
Published by Professor Priscilla Coleman of Bowling Green State University in the Journal of Psychiatric Research, the study showing women having abortions were at greater risk for anxiety as well as mood and substance abuse disorders.
Julia Steinberg of the University of California, San Francisco, and Lawrence Finer of the Guttmacher Institute, a pro-abortion group that is a former affiliate of the Planned Parenthood abortion business, have set out to disprove Coleman s findings.
They published their analysis in the journal Social Science & Medicine saying they failed to find the same links even taking similar factors into account. Full story at LifeNews.com
Second Protest of Carhart s Abortions Features 600 Pro-Lifers
A second protest took place on Saturday at the Germantown Reproductive Health Services abortion center that hired LeRoy Carhart to do late abortions.
Carhart, who was based in Nebraska until the state passed a fetal pain bill banning abortions after 20 weeks of pregnancy, came to Germantown to do abortions there since Maryland law is weak on abortion.
He faced an initial protest on Monday with as many as 600 people attending and another 600 people turned up on Saturday to continue the opposition to the abortion facility and Carhart s abortions late in pregnancy.
Saturday s protest was organized by the Catholic Archdiocese of Washington and Christa Lopiccolo, executive director of the department of life issues for the archdiocese, is worried Maryland is becoming a safe haven for abortions late in pregnancy because of the laxity of the law.

European Court to Rule on Ireland Abortion Law This Week
The European Court of Human Rights will rule on a key abortion case this week that affects not only the abortion law in Ireland but could have an affect on the rest of Europe.
The case involves the Ireland law that bans most abortions and the move could have more of a legal effect on the court s member states.
Abortion advocates hope to overturn Ireland s strong pro-life laws that prohibit abortions unless the life of the mother is in danger.
Women who had to travel to England for abortions claim they were denied their rights because the Irish pro-life abortion law requires them to travel out of the country for an abortion. Full story at LifeNews.com
Guam Governor Vetoes Bad Informed Consent Abortion Bill
Governor Felix Camacho of Guam has vetoed a bill that would have properly allowed women to know of abortion s risks and alternatives before having one had it not been watered down with amendments.
Bill 54-30, also known as the Woman s Reproductive Health Information Act of 2009, received approval from lawmakers after getting amendments based on recommendations from the attorney general s office.
The bill was sent to the attorney general s office in October for legal review by Sen. Frank Aguon Jr., chairman of the Committee on Economic Development, Health and Human Services and Judiciary, to ensure that the bill would stand up to constitutional legal challenges. Full story at LifeNews.com.
